The URL parameter is also valid, even though it is intended to "force" a
specific locale to be displayed. It overrides the locale handler setting.
The parameter is in no way "carried forward" with the <cms:link> tag, so
this is certainly somthing you must have in mind.

As others have already pointed out, you can write your own locale handler in
case you need different handling (not with the property). Handlers that user
session parameters and / or browser locales come to mind. The locale handler
is also configured in opencms-system.xml, and it's not overly hard to write
a different one.
