I was referring to the criteria listed at opensource.org, and to them (IMHO) hijacking the term "open source" to also require things like "freeware" etc.
E.g. I don't think the LGPL license fulfills the criteria.
And concerning "moral rights" - the whole idea about the concept of "moral rights" (or "droit moral" if you prefer) is that they cannot be taken away by any other means than changing the law granting them. This includes with the consent of the owner.

Hi Carl, Christian and list,
I am no expert about open source or licenses, but I am glad that such a debate is faced with clear, detailed and respectful comments. I can't find anything "aristocratic" in what Christian says, and I am quite positive that Comundus guys themselves are not offended because their possible alternatives are considered and respected. This is by the way also no personal attack whatsoever. Thanks to Christian, Carl and the rest of the list for their opinions. Greetings,
